    Divest-from-Israel Campaigns – Illegal?

    Summary: Campus and other divest-from-Israel campaigns may violate U.S. law aimed at protecting nations friendly to the U.S. from unsanctioned foreign boycotts.

    …. This boycott includes boycotting not only products produced in Israel, but also companies that do business in or with Israel. The boycott even goes as far as blacklisting ships that have docked in Israeli ports, regardless of the cargo’s point of origin or ultimate destination.

    In 1977, Congress passed a law creating the Office of Anti-boycott Compliance within the Department of Commerce, in response to the Arab boycott of Israel. The law prohibits U.S. persons from taking certain actions in support of an unsanctioned foreign boycott against a country that is friendly to the United States. Because Israel is an ally of the United States, and our government does not sanction the Arab boycott of Israel, the law prohibits actions that further or support the Arab League boycott of Israel.

    Over the past two years, a divest-from-Israel campaign has been gaining momentum on college campuses across the United States. In July 2003, the Zionist Organiztion of America expressed its concern about the campaign and about an upcoming national student conference supporting the Arab boycott of Israel. The ZOA urged the Office of Anti-boycott Compliance to investigate these activities as a possible violation of the antiboycott law. …

    September 8, 2010
    LOS ANGELES (JTA) — A proposed ballot initiative in California would force the state’s two public employee pension funds to withdraw investments from companies that “support Israeli settlement or supply military products to the government of Israel.”
    The Israel Divestment Campaign, a recently formed organization, will hold a demonstration Wednesday in front of the Israeli Consulate in Los Angeles, according to an e-mail announcement.
    The proposed initiative was submitted earlier this year to the California attorney general by the Israel Divestiture Forum-IDF: Committed to End Israeli Occupation. …
    To qualify as an initiative for next year’s ballot, supporters must collect the signatures of 434,000 registered California voters — a complex and expensive undertaking — by Jan. 31.
    California’s separate pension funds for public employees and for teachers provide a tempting target with their total investment portfolio of approximately $300 billion.

    Israel’s violation of Palestinian human rights and its settlements in and occupation of Palestine must end. Unfortunately, neither our federal government nor state governments are willing to take the necessary action to bring about peace to the region.

    Therefore, we have decided to take the question of human rights violations, settlements and Israel’s occupation directly to the voters of California. We believe an overwhelming majority of Californians agree that Israel needs to STOP building settlements on Palestinian land, end its occupation and allow Palestinians their right to return to their land.

    Therefore, this ballot measure is necessary in order to move the Middle East Peace Process toward a just resolution for both Israelis and Palestinians.

    In order to qualify the Divest from Israel Act for the next statewide ballot, 434,000 signatures must be gathered within a 5 month time period from September 1, 2010 to January 31, 2011.
